PERSONAL DATA PROCESSING POLICY

  1. Introduction
    1. DOT11, s. r. o., company ID: 07064934, with its place of business at V jehličí 2106/4, Krč, 142 00 Praha 4 (hereinafter referred to as the "Operator") operates a virtual content space designated „DOT11“ on the web interface http://www.dot11.cz (hereinafter referred to as the "Platform") and, as the controller, will process your personal data under the conditions set out below.
    2. The protection of your personal data is essential for the Operator. Your personal data will be processed in accordance with the relevant legal regulations, in particular Regulation (EU) No 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the "Regulation"), Act No 110/2019 Coll., on the processing of personal data, as amended (hereinafter referred to as the "Act"), and Act No 480/2004 Coll., on certain information society services, as amended.
  2. Categories of personal data and purposes of processing
    1. Personal data, within the meaning of the Regulation and the Act, are all information about an identified or identifiable natural person, such as their name, residence, email address, telephone number, IP address.
    2. Personal data of business partners. In the case of potential and actual business partners, the Operator processes personal data provided in connection with the negotiation and subsequent realization of mutual cooperation. This will mainly concern the following personal data: (i) name and surname (for the self-employed and for the contact person or person authorized to act on behalf of a legal entity within a specific contractual relationship); (ii) billing details (place of business, company ID, VAT ID, account number); (iii) contact details (email address, telephone number); (iv) data stated in the contract; (v) data on ongoing performance, including invoiced and paid amounts, communication with the business partner or contact persons.
    3. The personal data of business partners are processed for the purpose of (i) pre-contractual negotiation and the fulfillment of the Operator's obligations arising from the contractual relationship with the business partner, including the recovery of receivables within the meaning of Article 6(1)(b) of the Regulation; (ii) the fulfillment of the Operator's legal obligations arising from legal regulations, e.g. bookkeeping, advertising regulation, the prevention of criminal activity, etc., within the meaning of Article 6(1)(c) of the Regulation; (iii) the protection of the legitimate interests of the Operator and third parties, including records and administration, within the meaning of Article 6(1)(f) of the Regulation. Your special consent as a business partner is not required for this processing of personal data.
    4. Personal data of service users. In the case of service users, i.e. persons subscribed to the content newsletter, the Operator processes personal data provided in connection with the use of this service. This will mainly concern the following personal data: (i) email address; (ii) the date of subscription and the date of unsubscription; (iii) other data voluntarily provided by you within mutual communication (in person, by telephone, in writing or otherwise); (iv) which devices you use to log in to the service.
    5. The personal data of service users are processed for the purpose of direct marketing in the form of sending the Operator's commercial communications concerning the Platform, or other media operated by the Operator or its other products and services, including another purpose stated in the consent within the meaning of Article 6(1)(a) of the Regulation (hereinafter referred to as the "Consent"). Your prior Consent is required for this processing of the service user's personal data.
    6. For granting special Consent, the Platform uses a system called single opt-in confirmation, which means that the newsletter will be sent to you only if you have expressed Consent to the activation of the newsletter by providing the email address to which you want it sent, and at the same time clicked on the link „SUBSCRIBE“.
    7. Personal data of Platform visitors. In the case of Platform visitors, the Operator may process the following data: (i) the IP address from which your end device accesses the Platform; (ii) data obtained through cookie files (or other online identifiers), such as in particular information about your end device (browser type, its settings, operating system), basic geographical location, information about visited websites or used mobile applications, information about your interests, etc. Details can be found in the Cookie Usage document at www.dot11.cz.
    8. The personal data of Platform visitors are processed for the purpose of (i) the transmission of communication via an electronic communication network; (ii) the provision of an information service explicitly requested by the Platform visitor within the meaning of Article 6(1)(f) of the Regulation. Your special consent as a Platform visitor is not required for this processing of personal data.
    9. Personal data is stored in a secure database and is processed in electronic form by automated means. The Operator guarantees the security of the provided data.
    10. Personal data is not used for decision-making based purely on automated processing.
  3. Consent and its withdrawal
    1. You give consent to the processing of personal data as a service user, i.e. as a person subscribed to the content newsletter, voluntarily, and you may withdraw it at any time by a written request delivered (i) by email to info@dot11.cz, or (ii) by post to the address of the Operator's place of business, without any additional costs or consequences for the service user.
    2. This does not affect the lawfulness of processing based on Consent given before its withdrawal. The Operator is not responsible for the delivery of the withdrawal of Consent if you choose the route of unsecured email communication.
    3. The Operator has 30 days from the date of delivery of the withdrawal of Consent to handle the withdrawal of Consent to the sending of the newsletter.
  4. Processors and the period of processing of personal data
    1. The Operator, as the controller of personal data, is entitled to authorize other persons – processors of personal data – to process personal data for the Operator according to its instructions. Apart from the processors, there are no recipients who would have access to the processed personal data, either in the Czech Republic or abroad. The list of processors is published at www.dot11.cz.
    2. The above-mentioned personal data processed for the purpose of fulfilling obligations arising from the contractual relationship will be processed for a reasonable period with regard to the purpose of processing. When determining the appropriateness of the processing period, the Operator will proceed in particular from the length of the limitation period, the likelihood of legal claims being raised, common market practices and the likelihood and significance of impending risks.
    3. The above-mentioned personal data processed for the purpose of fulfilling the Operator's legal obligations will be processed for the period specified by the relevant legal regulation.
    4. The above-mentioned personal data processed for the purposes of protecting the legitimate interests of the Operator and third parties will be processed for the duration of the relevant legitimate interest.
    5. Personal data to whose processing you have given consent as a service user will be processed until your consent is withdrawn, unless they are deleted (destroyed) by the Operator earlier.
  5. Cookie files
    1. In order to improve the services provided, the website www.medialnichaos.cz, i.e. the Platform, uses so-called cookie files. You have the right not to grant consent to the use of cookies that are not strictly necessary for the technical functioning of the Platform, by disabling them in your web browser.   6. Rights regarding personal data
    1. The Operator processes personal data provided directly by you when concluding a contract, ordering a service, during the performance of the contractual relationship, from communication with you and when monitoring your activity on the Platform. In justified cases (recovery of performance, etc.), the Operator may also search for personal data in public registers.
    2. You have the right of access to all your personal data, you are entitled to request correction (rectification) and restricted processing, the erasure or blocking of personal data and their destruction. You also have the right to raise an objection with the Operator against the processing of your personal data, the right to withdraw your Consent to the processing of personal data at any time, and, in the case of an alleged violation of your rights, the right to request the Operator to provide a remedy or the right to turn to the Office for Personal Data Protection. You also have the right to the portability of your personal data. More detailed information on the individual rights is provided below:
      1. The right of access represents your right to require the Operator to provide information (confirmation) as to whether or not personal data concerning you is being processed. If the Operator processes your personal data, you have the right to obtain access to this data, together with other information concerning its processing.
      2. The right to rectification represents your right to require the Operator to correct inaccurate personal data, or, taking into account the purposes of processing, in some cases you also have the right to require the completion of incomplete personal data.
      3. The right to erasure represents the Operator's obligation to destroy the personal data processed about you under the conditions further regulated in Article 17 of the Regulation. Please note that the above procedure does not apply if the processing of personal data is necessary:
        1. for the exercise of the right to freedom of expression and information;
        2. for compliance with a legal obligation that requires processing under the law of the Union or a Member State applicable to the Operator, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Operator;
        3. for reasons of public interest in the area of public health;
        4. for archiving purposes in the public interest, for purposes of scientific or historical research, or for statistical purposes, where the right to erasure is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
        5. for the establishment, exercise or defense of legal claims.
      4. The right to restriction of processing represents your right to have the Operator restrict the processing of your personal data in the cases specified in Article 18 of the Regulation. If processing has been restricted on the basis of one of the grounds specified in Article 18 of the Regulation, the personal data concerned may, with the exception of their storage, be processed only with your consent, or for the establishment, exercise or defense of legal claims, for the protection of another natural or legal person, or for reasons of important public interest of the Union or a Member State. The Operator is obliged to inform you in advance of the lifting of the restriction of the processing of personal data.
      5. The right to portability represents your right to obtain your personal data that you have provided to the Operator in a structured, commonly used and machine-readable format, and the right to transmit this data to another controller, in the event that
        1. the processing of personal data is based on consent or on a contract; and
        2. the processing is carried out by automated means.
      6. When exercising your right to portability, you have the right to have the Operator transmit your personal data directly to another controller. This does not apply if the transmission is not technically possible. The right to portability does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority.
      7. The right to object to the processing of personal data, including profiling. If you exercise this right, the Operator will no longer process your personal data unless it demonstrates compelling and legitimate grounds that must override your rights and interests. The Operator may further process such personal data if it is necessary for the exercise and defense of legal claims. In the event that the objection is raised against processing for direct marketing purposes, the legitimate grounds of the Operator are no longer examined.
      8. If the Operator processes personal data on the basis of your consent, you have the right to withdraw this consent at any time. However, the withdrawal of consent does not affect the lawfulness of the processing of personal data until the time of the withdrawal of consent.
      9. If you wish to exercise any of your rights, contact the Operator at the address provided below. The Operator may charge a fee for handling the request only if the relevant legal regulations allow it.
